Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied and is accessible on our website or services in a way that constitutes copyright infringement, you may submit a written DMCA takedown notice to our designated Copyright Agent. For your notice to be valid under the DMCA, you must provide the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our website or services, sufficient to permit us to locate the material (e.g., URL(s) to the specific page(s) containing the material).
  3. Contact information of the complaining party: Your name, address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement that the information in the notification is accurate.
  6. Statement under penalty of perjury: A statement, made under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  7. Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification of the material, you have the right to submit a DMCA counter-notification. For your counter-notification to be valid under the DMCA, you must provide the following information:

  • Identification of the material: A specific identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Statement under penalty of perjury: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber's name, address, and telephone number.
  • Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Cinnamon Bun Popcorn may be found.
  • Statement of acceptance of service of process: A statement that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.
  • Physical or electronic signature: Your physical or electronic signature.
